Talk about a big idea! The development team at Dezer Development envisioned the redevelopment of the Intracoastal Mall around a harbour. The problem – no harbour. That detail became a design inspiration. The development team hired Zyscovitch to design a plan that brought the Intracoastal Waterway into the property to serve as the central design feature of a stunning new plan for an old shopping center.
The plan features 575,000 square feet of retail and office uses and 250 hotel rooms, 2000 residential units.
We served as co-counsel with Holland & Knight through the entitlements phase.
We served as lead litigation and appellate counsel to successfully defend several challenges that were brought in a failed attempt to derail the development.
At issue were complex matters relating to transportation planning, access, heights, density, and intensity.
The case resulted in a published decision styled E. Shores Prop. Owners Ass’n v. City of N. Miami Beach, No. 2021-02-AP, 2022 WL 203209 (Fla. 11th Cir. Ct. Jan. 10, 2022). Here’s a link to the decision.
