We represented the City of Miami Beach as Special Outside Counsel to defend the City’s approval of the first ultra-luxury Bvlgari Hotel in North America.
The Bvlgari Hotel South Beach will be located at the site of the former Seagull Hotel on 21st Street and Collins Avenue, within the City of Miami.
The redevelopment involved a series of regulatory approvals – including approval from the City’s Historic Preservation Board (the “HPB”).
A neighboring competitor unleashed a torrent of administrative and litigation challenges to the redevelopment and the City’s approval of it.
The challenges involved complex questions of real property law, administrative law, historic preservation, and appellate practice.
We successfully defended the City in all challenges.
Our representation resulted in a published opinion decision styled Setai Resort & Residences Condo. Ass’n v. BHI Miami Ltd., No. 2021-36-AP, 2023 WL 4450343 (Fla. 11th Cir. Ct. July 10, 2023) – here’s the link.
