Five Park
Our firm served as Special Outside Counsel to the City of Miami Beach in a complex regulatory dispute at the center of a public-private partnership for the redevelopment of a city park and adjacent lands. At issue was a metric that regulates development intensity – referred to as floor area ratio – and how to calculate certain elements of a proposed majestic residential tower. Together with counsel for the developer, we reached an amicable resolution of the matter despite a testy start.
The redevelopment of the park at 5th Street and Alton Road was a key aspect of the deal. The developer funded the design and construction of a state-of-the-art park engineered to manage storm surge and tidal flooding with the best available green technologies such as bioswales and sub-surface cisterns.
The park is designed to provide key drainage capacity in this low-lying area of the city that is prone to flooding.
