Private Judging
Business moves fast – the judicial process does not. Given these givens, the Florida Legislature adopted Section 44.104, Florida Statutes, to allow parties to hire a private judge to resolve their matter expeditiously subject to the same process and procedure that would govern a case in the courthouse. There are two differences: (i) the clients choose the private judge and (ii) the clients pay the private judge an agreed-upon fee. Although the private judging statute is relatively new, Jennifer Bailey just concluded a three (3) week construction trial in which she sat as a private judge in Naples, Florida.
Arbitration
We possess expertise within the Large Complex Commercial and Construction Panels of the American Arbitration Association/International Center for Dispute Resolution. Our Jennifer Bailey heads up this practice area where she draws upon her thirteen years serving on Miami’s business court resolving complicated commercial disputes and a wide variety of complex cases including mass torts, product liability, construction defects, healthcare, business dissolutions and international disputes. Jennifer’s nationally recognized expertise in case management – spanning from narrow issues with limited parties to large numbers of parties and claims – allows her to deliver swift, expert, and efficient resolution of the underlying disputes.
Special Magistrate Proceedings
Our extensive litigation, appellate, and judicial experience uniquely qualifies us to serve in the role of special magistrate by judicial appointment. Our goal in this practice area – as in all of our practice areas – is to help parties resolve their disputes expeditiously and efficiently.
Mediation
We understand conflict – we understand how to resolve it. Mediation is all about conflict resolution by the parties – the mediator is just the facilitator. For the right case, and under the right circumstances, we are available to mediate. This, however, is a not a focus of our practice. So please do not be surprised or disappointed if we say no to a mediation. There are many fabulous mediators in the region to help your clients and you.
