St. Lucie County Case
We represent St. Lucie County as Special Outside Counsel in complex land use disputes.
Most recently, we successfully defended the County in federal court from a challenge alleging that the County’s enforcement of its land development regulations represented the deprivation of the constitutional right to equal protection.
The case sought to impose liability against the County under a strand of equal protection jurisprudence known as a “class of one” case.
Working alongside the great lawyers in the Office of the County Attorney, we were able to obtain summary judgment in federal court.
We were thereafter able to obtain summary judgment on the plaintiff’s stated court claims.
The case resulted in written orders from both the federal and state court. Here’s a link to the federal order and the state decision.
